Introduction

Welcome to flyairq.com (hereinafter referred to as “the Portal”, “Fly AirQ ” “Us”). By accessing or using our ticket booking website/portal (the “Platform”), The user (hereinafter referred to as “The user”, “you” agrees to comply with and be bound by the following terms and conditions (the “Terms”). These Terms govern the use of the Platform and the purchase of tickets through it. If you do not agree with any part of these Terms, please do not use our Platform.

User Eligibility

The user must be at least 18 years old or the age of majority in your jurisdiction to use the Platform and purchase tickets. By using our Platform, the user confirm that you meet the eligibility requirements.

Account Registration and Security

To use the Platform, the user is required to create an account and provide accurate, current, and complete information. The user is responsible for maintaining the confidentiality of account information, including password and agrees to immediately notify us of any unauthorized access or use of your account. Fly AirQ is not liable for any loss or damage resulting from failure to protect the account details.

Ticket Booking and Payments

The user agrees to provide accurate and complete information when booking tickets on the Platform. All ticket bookings are subject to availability and confirmation from the event organizers or service providers. Payments for tickets are processed through secure payment gateways. The user is responsible for all charges associated with the transaction, including any applicable taxes, fees, or charges imposed by third parties. Ticket prices are subject to change at any time without prior notice as per the seat availability. Fly AirQ reserves the right to modify prices, including applying additional fees, without prior notice.

 Fly AirQ may charge certain amount of service charges and has right to change the service fees time and again without prior notice. Fly AirQ retains the right to change the balance in future transactions in the event that there is an undercharging for technical reasons.

Visa Obligations

It is soley the responsibility of the user to fulfill the visas and other necessary documents need to travel. Fly AirQ does not bear any responsibility in case of the user not being able to travel due to documentation issues. Bookings that are not completed for any reason are not refundable, and Fly AirQ is not responsible for the same.

Ticket Delivery and Usage

Tickets are delivered electronically to the email address you provide during booking. The user is responsible for ensuring that you have access to the email address used for receiving tickets and that you can display the electronic ticket(s) at the airport.

Cancellation and Refunds

Refunds and cancellations are subject to the policies set by the third party (Airlines). Please review specific cancellation policy before purchasing the tickets. The user is required to check if the tickets are refundable or non-refundable before issuing the tickets. Once the booking is confirmed, the ticket(s) are issued electronically and are non-transferable.

Applicable charges may apply as per the airline's policy in case of refund or reissue of the tickets. In case of flight cancellation you may be entitled for full refund or reschedule as per availability and Fly AirQ does not include any additional expenses beyond the amount charged for the services. Fly AirQ will notify the user of any changes, and Fly AirQ will assist in processing refunds or exchanges as per the policies. Fly AirQ does not guarantee refunds for tickets unless specified by the third party (Airlines).

Platform Usage and Restrictions

The user agrees not to use the Platform for any unlawful purpose, including but not limited to:

- Using automated systems or scripts to collect information from the Platform.

- Attempting to access or interfere with the security features of the Platform.

- Violating any applicable laws or regulations.

- Not to resell or reproduce any tickets obtained through the Platform without proper authorization.

Event Changes or Cancellations

Fly AirQ does not control or guarantee regarding the flight schedules. In case of flight changes, cancellations, or delays, Fly AirQ will do its best to notify you and provide guidance on how to proceed. Also, Fly AirQ is not liable for any losses, damages, or inconveniences caused by flight changes, cancellations, or delays.

Privacy Policy

Your privacy is important to us. By using the Platform, you consent to the collection, storage, and use of your personal data in accordance with our Privacy Policy. Fly AirQ will not share your personal information with third parties unless required by law or for processing the transaction.

Third-Party Account

By using Fly AirQ’s portal the user gives permissions to Fly AirQ and its representatives to access third-party sites, such as banks, financial institutions, and other payment gateways.

Limitation of Liability

To the fullest extent permitted by applicable law, Fly AirQ will not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform or the purchase of tickets. Fly AirQ is not responsible for any issues related to the event, including but not limited to cancellations and delays.

Indemnity

You agree to indemnify, defend, and hold harmless Fly AirQ, its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, costs, and expenses, including legal fees, arising from:

- Your use of the Platform.

- Your violation of these Terms.

- Any breach of representations or warranties made by you.

Modifications to Terms

Fly AirQ reserves the right to update or change these Terms at any time, and such changes will be effective immediately upon posting on the Platform. You should review these Terms periodically to stay informed of any changes. Continued use of the Platform after any modifications constitutes acceptance of the revised Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Nepal Government. Any disputes arising out of or relating to these Terms will be resolved through mediation/arbitration before a competent authority in Nepal.

Refusal to Provide Service

Fly AirQ reserves the full right to refuse to provide the service without further explanations if the requirement is not met and the dues are not cleared on time. Fly AirQ deserves the full right to limit or end user's activity, suspend or terminate the registration, and deny website access without prior notice in case of violation or breach of agreement or Fly AirQ believes that the user's actions could result in liability for themselves, other users of portal, or third parties according to prevailing law.
